Terms and Conditions

1. Introduction
1.1 Application of Terms
These Terms and Conditions apply to all quotes, bookings, invoices, payments, event services and related communications between DJ Bass Sick and the client.
1.2 Agreement to Terms
By paying a deposit, confirming a booking in writing, accepting a quote, signing an agreement, or proceeding with services after receiving these Terms and Conditions, the client agrees to be bound by these Terms and Conditions.
1.3 Key Definitions
In these Terms and Conditions:
- “DJ Bass Sick”, “we”, “us” or “our” means DJ Bass Sick and Christopher Totonjian.
- “Client”, “you” or “your” means the person, business, organisation or authorised representative making the booking.
- “Event” means the event, function, performance, party, celebration or booking for which DJ Bass Sick is engaged.
- “Venue” means the location or premises where the event is held.
- “Booking” means the agreed engagement of DJ Bass Sick for an event.
- “Deposit” or “booking fee” means the amount required to secure the booking date.
- “Services” means the DJ, sound, lighting, music planning, MC, setup, pack-down and related services agreed in writing.
2. Quotes, Bookings and Acceptance
2.1 Quote Validity
Unless otherwise stated in writing, quotes are valid for two weeks from the date they are issued. After this period, pricing, availability and package inclusions may change.
2.2 Booking Confirmation
A booking is not secured until:
- the required deposit has been received by DJ Bass Sick; and
- DJ Bass Sick has sent a confirmation email confirming receipt of the deposit and outlining the booking details.
2.3 Deposit Required to Secure Booking
A deposit of $200 is required to secure the event date specified in the client’s quote, unless a different deposit is stated in the quote or invoice. The deposit is deducted from the total booking amount.
2.4 Accurate Event Information
The client must provide accurate event information so DJ Bass Sick can prepare an appropriate quote. This may include the event date, location, event type, duration, venue or event space, number of guests, access to electricity, access details, parking/loading information, indoor or outdoor event details, preferred package and any venue restrictions.
2.5 Right to Decline a Booking
DJ Bass Sick may decline a booking before confirmation, including where the event requirements, location, timing, venue conditions, legal requirements, safety risks or service expectations are unsuitable or unavailable.
3. Services Provided
3.1 Agreed DJ Services
DJ Bass Sick provides DJ performance services for the agreed event date, location and performance time stated in the most recent quote, invoice or written booking confirmation.
3.2 Included Services
Services may include DJ performance, sound equipment, lighting equipment, music planning, setup, pack-down, travel within agreed service areas and optional add-ons, depending on the package or written agreement.
3.3 Services Only Included If Agreed
MC services, additional equipment, extended travel, extra lighting, additional sound, earlier setup, late-night pack-down, extended performance time or other add-ons are only included if listed in the quote or invoice or agreed in writing.
3.4 Services Not Included
Unless expressly agreed in writing, services do not include event planning, event coordination, venue hire, security, crowd control, music licensing for the event, power supply, staging, shelter, generators, permits, council approvals, parking fees, additional staff or any service not listed in the quote or invoice.
4. Fees, Deposits and Payment
4.1 Payment Methods
Deposits may be paid by bank transfer, bank deposit or credit card where available. The remaining balance may also be paid by cash, where agreed.
4.2 Final Payment
The remaining balance must be paid before the event commences, unless otherwise agreed in writing. DJ Bass Sick is not required to commence performance or provide services until all amounts due before the event have been paid.
4.3 Late Payment
Late payment will incur a late fee of 10% of the remaining balance, compounding monthly, unless prohibited by law. The client is responsible for any reasonable costs incurred by DJ Bass Sick in recovering unpaid amounts.
4.4 Additional Charges
Additional charges may apply for travel, parking, tolls, difficult access, stairs, waiting time, additional setup requirements, additional equipment, extended hours, earlier access requirements or services not included in the original quote.
4.5 Overtime Rate
The overtime rate is 150% of the hourly rate stated in the invoice, calculated in 30-minute increments and rounded up to the nearest 30 minutes, unless another overtime rate is agreed in writing.
4.6 GST and Tax Invoices
GST will only be charged where DJ Bass Sick is registered for GST or otherwise required to charge GST. Where applicable, DJ Bass Sick will issue tax invoices in accordance with Australian tax requirements.
5. Client Cancellations and Refunds
5.1 How to Cancel a Booking
Cancellations must be made by the client in writing by text message or email from the client’s phone number or email address. The client must clearly identify the booking they wish to cancel. A cancellation is not effective until received by DJ Bass Sick.
5.2 Cancellation More Than a Week Before the Event
The accepted cancellation notice period is any time more than two weeks before the event commences.
5.3 Cancellation Within a Week of the Event
If the client cancels within a week before the event commences, 50% of the total invoiced amount is payable.
5.4 Cancellation Within Four Hours or During the Event
If the client cancels within four hours before the event commences, or during the event, the total invoiced amount is payable.
5.5 Deposit Treatment
The deposit is non-refundable if the client cancels the booking or changes the booking date, subject to any rights the client may have under Australian Consumer Law.
5.6 Refunds
If the booking is cancelled more than a week before the event, any funds paid above the deposit amount will be refunded. If the booking is cancelled within a week before the event, any funds paid above 50% of the total invoiced amount will be refunded.
5.7 Refund Method and Timing
Approved refunds will be made by bank transfer to an account nominated by the client within one week of the client providing the required bank details.
6. Postponements and Date Changes
6.1 Requesting a Date Change
Requests to postpone or change the event date or time must be made in writing. DJ Bass Sick is not required to accept a date change unless the new date, time and event requirements are available and agreed in writing.
6.2 Deposit Transfers
Deposits are non-transferable within eight weeks of the event date, unless DJ Bass Sick agrees otherwise in writing or Australian Consumer Law requires a different outcome.
6.3 Single Deposit Transfer
Where DJ Bass Sick agrees to transfer a deposit, the deposit may be transferred to one new available event date only. Further date changes may require a new deposit or revised booking terms.
6.4 Changes to Price or Event Details
Pricing may vary between dates, times, venues, locations, packages and event requirements. DJ Bass Sick may issue a revised quote or invoice for the new date or changed booking details.
7. Cancellations, Changes or Replacement DJ by DJ Bass Sick
7.1 Illness, Emergency or Events Beyond Control
DJ Bass Sick may need to cancel, postpone, vary or arrange alternative services due to illness, injury, emergency, transport failure, family emergency, unsafe conditions, force majeure or circumstances beyond reasonable control.
7.2 Client Breach or Unsafe Conditions
DJ Bass Sick may also cancel, pause, delay or stop services if the client breaches these Terms and Conditions, fails to pay amounts due, provides materially incorrect information, fails to provide required access, or creates unsafe or unsuitable event conditions.
7.3 Client Breach of Terms
Where practical, DJ Bass Sick may attempt to assist with arranging a suitable replacement DJ if DJ Bass Sick is unable to perform due to illness, injury or emergency. The client may accept or decline any proposed replacement DJ.
7.4 Refunds Where DJ Bass Sick Is at Fault
If DJ Bass Sick cancels and does not provide services due to reasons within DJ Bass Sick’s reasonable control, the client will receive a refund for services not provided, subject to Australian Consumer Law and any agreed alternative arrangement.
7.5 Limits for Circumstances Outside DJ Bass Sick’s Control
DJ Bass Sick is not responsible for losses arising from circumstances outside reasonable control, including venue closure, power failure, weather, council restrictions, police directions, client breach, guest misconduct, unsafe event conditions or force majeure.
8. Client and Venue Responsibilities
8.1 Correct Event Details
The client must provide the correct event date, time, location, venue details, package requirements, guest numbers and event type, and must notify DJ Bass Sick promptly of any changes.
8.2 Required Information
The client must also provide, where relevant:
- venue contact details;
- access instructions;
- parking and loading information;
- security entry, gate codes, lift access, stairs or other access requirements;
- run sheet or timeline no later than three days before the event;
- music preferences no later than three days before the event;
- venue rules, sound limits, access rules, power restrictions, curfews or setup requirements no later than three days before the event;
- power availability no later than one week before the event; and
- a wet weather plan no later than one week before the event for outdoor or partly outdoor events.
8.3 Responsible Event Contact
The client must nominate a responsible event contact who is available before and during the event to answer questions, make decisions and communicate with venue staff where required.
8.4 Compliance with Laws, Permits and Venue Requirements
The client is responsible for ensuring the event complies with applicable laws, venue requirements, permits, council rules, noise restrictions, liquor licensing conditions, music licensing requirements and any other legal or regulatory requirements, unless DJ Bass Sick has expressly agreed in writing to take responsibility for a specific requirement.
9. Venue Access, Setup and Pack-Down
9.1 Minimum Setup Time
Unless otherwise agreed in writing, the minimum setup time required before the event is:
- Small package: 1 hour;
- Medium package: 1 hour and 30 minutes;
- Large package: 2 hours; and
- X-Large package: 2 hours.
9.2 Pack-Down Time
The minimum pack-down time required is the same as the applicable setup time, unless otherwise agreed in writing. The client must ensure safe access remains available for setup and pack-down.
9.3 Safe and Direct Access
The client must ensure safe and reasonably direct access from the loading area or vehicle to the performance area. Additional charges may apply for indirect parking, unavailable loading access, long carry distances, restricted loading times, paid parking, lack of nearby parking, stairs, lifts, uneven surfaces, steep paths, grass, gravel, sand, unlit access or other difficult access conditions.
9.4 Delays Caused by Client or Venue
DJ Bass Sick is not responsible for delays caused by the client, venue, guests, suppliers, late access, blocked access, unavailable parking, incorrect instructions, late setup access or unsafe conditions. If setup is delayed due to circumstances outside DJ Bass Sick’s control, the agreed finish time will still apply unless overtime is agreed and paid.
9.5 Safe Performance Area
The DJ performance area must be stable, dry, level, safe and suitable for DJ Bass Sick’s equipment and performance. The client or venue must provide enough room for DJ equipment, speakers, lighting and safe cable management.
9.6 Table, Booth or Stage Surface
DJ Bass Sick will provide a table or booth for equipment unless the client or venue agrees to provide one before the event. Any table, stage or setup surface provided by the client or venue must be stable, level and suitable for DJ equipment.
9.7 Protection from Guests and Venue Traffic
Equipment must not be placed where guests, venue staff, children, doors, pathways, serving areas or other venue traffic may interfere with or damage equipment.
9.8 No Unauthorised Handling of Equipment
Only DJ Bass Sick or authorised assistants may move, adjust, operate, disconnect or handle DJ Bass Sick’s equipment.
10. Power Requirements
10.1 Required Power Supply
Unless otherwise agreed in writing, the client must provide a standard 240V / 10A / AC power outlet within 20 metres of the performance area.
10.2 Safe Power
Power must be safe, compliant, accessible and suitable for DJ equipment. The client is responsible for ensuring the venue or event location can provide safe power.
10.3 Unsafe Power Conditions
DJ Bass Sick may refuse to operate equipment, or may pause, delay or stop services, if power is unsafe, unstable, overloaded, exposed to weather, non-compliant or otherwise unsuitable.
10.4 Extension Leads and Cable Safety
DJ Bass Sick may provide extension leads, cable covers or cable management where required and suitable. The client and venue must not interfere with cable management or safety equipment.
10.5 Generators
If generators are used, they must be suitable, stable, safe, properly operated and approved by DJ Bass Sick before the event. DJ Bass Sick may refuse to connect equipment to a generator considered unsuitable or unsafe.
10.6 Power Failure or Electrical Issues
DJ Bass Sick is not responsible for service disruption caused by venue power failure, unsafe power, generator failure, electrical faults, blown circuits, power outages or other electrical issues outside DJ Bass Sick’s control.
11. Outdoor Events, Weather, Noise and Venue Rules
11.1 Outdoor Event Requirements
Outdoor bookings require suitable shelter, safe and level ground, safe access, weather protection and access to safe and suitable power.
11.2 Shelter and Weather Protection
The client must provide adequate shelter for DJ Bass Sick and all equipment from rain, wind, direct sun, dust, drinks, food and excessive heat, unless otherwise agreed in writing.
11.3 Wet Weather Backup Plan
The client must provide a backup indoor or covered location for outdoor or partly outdoor events. The backup location must be suitable for DJ equipment and safe performance.
11.4 Right to Pause, Delay or Stop Services
DJ Bass Sick may pause, delay or stop setup or performance where DJ Bass Sick reasonably considers it unsafe to continue due to weather, ground conditions, heat, wind, rain, power exposure, guest behaviour, venue conditions, sound restrictions or any other safety issue.
11.5 Noise Restrictions
The client is responsible for checking venue, council and neighbourhood noise requirements and notifying DJ Bass Sick of any relevant restrictions before confirming the booking.
11.6 Sound Limiters and Authorised Directions
DJ Bass Sick must comply with venue sound limiters, venue staff directions, licence conditions, council requirements, police directions, security directions and lawful directions from authorised persons.
The client must notify DJ Bass Sick before accepting the booking if the venue has a sound limiter. DJ Bass Sick may decline or cancel a booking where a sound limiter or venue sound restriction is unsuitable for the agreed service. Where the client failed to disclose a known sound limiter or sound restriction before booking, DJ Bass Sick may cancel the booking without refund, subject to Australian Consumer Law.
11.7 No Refunds for External Restrictions
No refund will apply where services are restricted, delayed, reduced or stopped due to unsafe weather, inadequate shelter, external noise restrictions, venue rules, council requirements, police directions, neighbour complaints, sound limiters or other circumstances outside DJ Bass Sick’s control, subject to Australian Consumer Law.
12. Music, Playlists, Requests and Formalities
12.1 Music Preferences
The client must provide preferred genres, artists, playlists, must-play songs, do-not-play songs and key songs no later than three days before the event. Where music preferences are not provided by this time, DJ Bass Sick will use professional discretion for song selection.
12.2 Playlists and Must-Play Songs
Playlists should not be longer than the duration of the event unless otherwise agreed. Must-play songs should be clearly identified, including any required timing.
12.3 Guest Requests
Guest requests may be accepted at DJ Bass Sick’s discretion unless the client specifies otherwise before the event.
12.4 DJ Discretion and Crowd Reading
DJ Bass Sick retains professional discretion to choose music based on the crowd, event type, timing, atmosphere, age group, client preferences, venue restrictions and suitability.
12.5 Song Availability and Suitability
Specific songs are subject to availability, suitability, timing and DJ Bass Sick’s professional discretion. DJ Bass Sick is not responsible where a song is unavailable, incorrectly identified by the client or unsuitable for the event.
12.6 Explicit or Inappropriate Music
DJ Bass Sick may refuse to play music that is offensive, unsafe, inappropriate, unlawful, unsuitable for the event, inconsistent with venue requirements or inconsistent with the client’s event brief.
12.7 School, Family, Youth and Corporate Events
For school, family, youth and corporate events, clean versions and age-appropriate selections may be required. The client must advise DJ Bass Sick of any content restrictions before the event.
12.8 Formalities and Key Moments
Any announcements, speeches, formalities, event timing requirements, first dance songs, entrance songs, farewell songs, pronunciation notes or special instructions should be listed in the run sheet or timeline provided to DJ Bass Sick.
12.9 MC Duties
MC duties are only included if they are listed in the invoice or agreed in writing. Where MC duties are not included, DJ Bass Sick may still make limited basic announcements at discretion but is not required to act as formal host or event coordinator.
12.10 Accuracy of Client Information
13. Event Timing, Overtime and Schedule Changes
13.1 Agreed Performance Times
The performance time, start time and finish time are the times stated in the most recent invoice or written booking confirmation.
13.2 Delays to the Event Schedule
Delays caused by the client, venue, guests, speeches, meals, formalities, suppliers, access issues or other circumstances outside DJ Bass Sick’s control do not change the agreed finish time unless overtime is agreed by the client, the venue and DJ Bass Sick.
13.3 Overtime Requests
Overtime is subject to DJ Bass Sick’s availability, venue approval, noise restrictions, licence conditions and payment of the applicable overtime rate.
13.4 Venue Curfews and Restrictions
Venue curfews, sound restrictions, licence conditions, council rules, police directions and venue staff directions override overtime requests.
13.5 Early Finish
No refund will apply if the event ends early due to the client, venue, guests, venue restrictions, police directions, council directions, noise complaints, event schedule changes or any person or circumstance other than DJ Bass Sick, subject to Australian Consumer Law.
14. Music Licensing
14.1 Possible Licensing Requirements
Music licensing may be required for public, commercial, school, venue, ticketed, corporate or other events. Relevant licensing may involve APRA AMCOS, PPCA or OneMusic Australia.
14.2 Client, Venue or Organiser Responsibility
Unless agreed otherwise in writing, the client, venue or event organiser is responsible for ensuring the event has all required music licences, permits, approvals and venue permissions.
14.3 DJ Bass Sick Licensing Responsibility
DJ Bass Sick is only responsible for event music licensing if this is specifically agreed in writing.
14.4 Different Event Types
Different licensing obligations may apply depending on whether an event is private, public, commercial, ticketed, school-based, venue-based or otherwise subject to licensing requirements.
15. Safety, Behaviour, WHS and Equipment Damage
15.1 Safe Working Environment
The client must provide and maintain a safe working environment for DJ Bass Sick, assistants, guests, venue staff and equipment.
15.2 Unsafe Behaviour or Conditions
DJ Bass Sick may pause, delay, stop or cancel services if there is aggression, abuse, threats, harassment, violence, intimidation, intoxicated guest behaviour, equipment interference, unsafe power, unsafe weather, unsafe access, unsafe venue conditions or any behaviour or condition that creates a risk to people or equipment.
15.3 Security and Crowd Management
The client or venue is responsible for security, crowd management and guest control. DJ Bass Sick is not responsible for controlling guests or providing security.
15.4 Equipment Interference and Food or Drinks
Guests must not touch, tip, move, lean on, climb on, operate, disconnect, spill drinks on or otherwise interfere with equipment. Food, drinks and liquids must be kept a safe distance from DJ Bass Sick’s equipment.
15.5 Client Responsibility for Loss or Damage
The client accepts responsibility for loss, damage, injury or additional costs caused by the client, guests, venue staff, contractors, suppliers, event conditions or unsafe venue arrangements, to the extent permitted by law.
15.6 Repair, Replacement and Cleaning Costs
Where the client or their guests are at fault, the client must compensate DJ Bass Sick for reasonable repair, replacement, cleaning, transport, assessment or recovery costs required to return equipment to its original and fully operational state.
15.7 Cable Safety and Equipment Safety
Guests, venue staff, suppliers and contractors must not interfere with cable management, cable covers, power leads, lighting stands, speakers or safety equipment.
15.8 Unsafe Work and Incident Reporting
DJ Bass Sick reserves the right to refuse unsafe work. Incidents, injuries, hazards, near misses or damage should be recorded and reported where required by law, venue policy, insurance requirements or reasonable business practice.
16. Noise Restrictions and Venue Compliance
16.1 Disclosure of Child-Related Events
The client must disclose before booking if the event is child-related or involves children or young people in a child-related context.
16.2 Working With Children Check Requirements
DJ Bass Sick will comply with applicable NSW Working With Children Check requirements where required by law.
16.3 School, Youth and Children’s Events
School events, youth events, children’s parties and similar events may require additional safety, supervision, music content or compliance requirements.
16.4 Adult Supervision
The client, school, venue, organiser or responsible adults remain responsible for supervision, behaviour management, safety and care of children and young people at the event.
16.5 Age-Appropriate Music
Clean or age-appropriate music may be used where required. The client must notify DJ Bass Sick of any content restrictions before the event.
17. Insurance
17.1 Insurance Held by DJ Bass Sick
DJ Bass Sick maintains public liability, product liability, performing equipment insurance and personal accident insurance through the relevant Duck for Cover Entertainers Group Inc membership and associated policy arrangements, subject to the terms, conditions, exclusions, limits and endorsements of the current policies.
17.2 Public and Product Liability
As at the current certificates provided to DJ Bass Sick, the General & Products Liability Insurance certificate lists Christopher Totonjian, performing names DJ Christo and Bass Sick, with insured activity DJ (excluding venue hire) and a public liability limit of $30,000,000 per occurrence. The same certificate lists product liability of $30,000,000 per occurrence and in the aggregate during the period of insurance.
17.3 Equipment and Personal Accident Insurance
As at the current certificates provided to DJ Bass Sick, the performing equipment insurance certificate lists a sum insured of $10,000 any one claim or occurrence, subject to item limits, excesses, policy terms and exclusions. The personal accident insurance certificate applies while engaged in declared performing arts activities, including commuting to and from such activities, subject to policy terms, conditions and exclusions.
17.4 Certificates of Currency
A certificate of currency may be provided to clients, venues or organisers on request. Certificates of currency are issued as a summary of cover only and do not amend, extend, replace or alter the terms, conditions, definitions, limitations or exclusions of the relevant policy.
17.5 Client and Venue Insurance
Clients, venues and event organisers are responsible for maintaining their own insurance, including public liability, property, event, venue, cancellation or other insurance where required.
17.6 Insurance Exclusions and Limits
Insurance may not cover all claims, losses, damage, injury, theft, venue issues, guest misconduct, client breach, unsafe conditions or circumstances outside the scope of the relevant policy. The existence of insurance does not make DJ Bass Sick responsible for matters outside DJ Bass Sick’s legal responsibility.
18. Photography, Video and Privacy
18.1 Event Photos and Videos
Insurance may not cover all claims, losses, damage, injury, theft, venue issues, guest misconduct, client breach, unsafe conditions or circumstances outside the scope of the relevant policy. The existence of insurance does not make DJ Bass Sick responsible for matters outside DJ Bass Sick’s legal responsibility.
18.2 Promotional Use
Photos or videos may be used for DJ Bass Sick’s website, social media, portfolio, advertising or other marketing purposes unless the client opts out before the event.
18.3 Children, Schools and Sensitive Private Events
DJ Bass Sick will not intentionally use identifiable images of children, school events or sensitive private moments for promotional purposes without appropriate permission from the client, organiser or relevant responsible party.
18.4 Information Collected
DJ Bass Sick may collect names, phone numbers, email addresses, event details, venue details, music preferences, payment records, run sheets, communications and information reasonably required to provide services.
18.5 Use of Information
Client information is used for quotes, bookings, event preparation, communication, invoicing, payment management, service delivery, recordkeeping and related business purposes.
18.6 Sharing Information
Relevant information may be shared with venues, assistants, replacement DJs, suppliers, insurers or professional advisers where reasonably required to deliver services, manage the booking, resolve an issue or comply with legal obligations.
18.7 Marketing Communications
Clients consent to receive marketing material from DJ Bass Sick unless they opt out. Clients may opt out of marketing communications at any time.
19. Australian Consumer Law and Liability
19.1 Consumer Rights
DJ Bass Sick will uphold consumer rights protected under Australian Consumer Law. Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
19.2 Due Care, Skill and Fitness for Purpose
DJ Bass Sick will provide services with due care and skill, and services will be reasonably fit for the purpose made known by the client, except where the client does not rely on DJ Bass Sick’s skill or judgment or where it is unreasonable to do so.
19.3 Timing of Services
Services will be provided within the agreed time stated in the most recent invoice or written booking confirmation, or otherwise within a reasonable time.
19.4 Refunds and Remedies
Refunds, credits, re-performance or other remedies will be handled in accordance with Australian Consumer Law and these Terms and Conditions, to the extent these Terms and Conditions are permitted by law.
19.5 Limits Permitted by Law
DJ Bass Sick’s liability is limited only to the extent permitted by law. Nothing in these Terms and Conditions limits liability where it would be unlawful to do so.
19.6 Losses Outside DJ Bass Sick’s Control
DJ Bass Sick is not responsible for issues caused by events outside reasonable control, including venue restrictions, power failure, weather, road closures, client breach, guest conduct, police directions, council directions, noise restrictions, unsafe event conditions or force majeure.
19.7 Indirect or Consequential Loss
To the extent permitted by law, DJ Bass Sick is not liable for indirect, consequential, special or economic loss, loss of enjoyment, loss of profit, reputational damage or other losses not directly caused by DJ Bass Sick’s breach.
19.8 Maximum Liability
To the extent permitted by law, DJ Bass Sick’s maximum liability to the client is limited to the amount paid by the client to DJ Bass Sick for the booking giving rise to the claim.
20. Force Majeure, Complaints, Disputes, Governing Law and Changes
20.1 Force Majeure
Force majeure means unforeseen or extraordinary circumstances beyond the reasonable control of DJ Bass Sick, the client or the venue that prevent, delay or materially affect the performance of the booking. This may include extreme weather, natural disasters, storms, floods, bushfires, pandemics, road closures, accidents, transport failures, vehicle breakdowns, illness, injury, family emergency, medical emergency, venue shutdown, blackout, power outage, essential service failure, unsafe venue conditions or lawful directions from government authorities, police, council, emergency services, health authorities or other authorised persons.
20.2 Effect of Force Majeure
Where force majeure prevents the booking from proceeding, the booking may be cancelled, postponed or rescheduled. The deposit is non-refundable, but may be transferred to one available new booking date where DJ Bass Sick agrees and where this is consistent with Australian Consumer Law.
20.3 Raising Concerns or Complaints
Clients should raise concerns as soon as they arise during the event so DJ Bass Sick has a reasonable opportunity to address them. Formal complaints must be made in writing and should be sent within five days of the event.
20.4 Good Faith Resolution
Both parties agree to attempt to resolve concerns, complaints or disputes reasonably, rationally and in good faith. The client should provide relevant details, photos, videos, communications, venue information or other supporting material relating to any complaint. DJ Bass Sick may also provide relevant details, photos, videos, communications or other evidence in response.
20.5 Mediation and Escalation
If a dispute cannot be resolved between the parties, external mediation may be required before legal proceedings are commenced, unless urgent legal action is necessary or mediation is not appropriate.
20.6 Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Australian federal laws, including Australian Consumer Law, apply where relevant. Disputes are handled in NSW courts or tribunals where they cannot be resolved between the client and DJ Bass Sick, with or without external mediation.
20.7 Severability
If any term is invalid, unenforceable or unlawful, the remaining terms continue to apply to the maximum extent permitted by law.
20.8 Changes to These Terms
DJ Bass Sick may update these Terms and Conditions from time to time. The Terms and Conditions provided at the time of booking apply to the confirmed booking unless both parties agree otherwise in writing.
20.9 Special Conditions and Written Agreement
Special arrangements, variations or exceptions must be confirmed and agreed in writing. If there is a specific written booking agreement, quote, invoice or booking confirmation that conflicts with these general Terms and Conditions, the specific written booking agreement, quote, invoice or booking confirmation may override these Terms and Conditions to the extent of the inconsistency.
20.10 Entire Agreement
The written quote, invoice, booking confirmation and these Terms and Conditions form the full agreement between the parties, unless otherwise agreed in writing.
